Standard Business Terms & Conditions

  1. Definitions

“Company” refers to First World Movers & Freighters Ltd. “Client” refers to the customer engaging the Company’s services. “Shipment” refers to cargo, goods, containers, or documents handled by the Company.

  1. Scope of Services

The Company provides logistics and freight forwarding services including air freight, sea freight, customs clearance, warehousing, inland transportation, cargo handling, and related logistics services.

  1. Quotations

All quotations are based on information provided by the Client and are subject to change without prior notice due to carrier surcharges, exchange rates, taxes, customs duties, or government levies. Additional charges arising from inspections, storage, demurrage, detention, or delays shall be borne by the Client.

  1. Payment Terms

Full payment may be required before cargo release unless otherwise agreed in writing. The Company reserves the right to withhold cargo/documents pending settlement of outstanding balances.

  1. Duties, Taxes & Government Charges

Customs duties, VAT, IDF, KEBS, ACA, NEMA permits, and statutory charges remain the responsibility of the Client.

  1. Client Obligations

The Client shall provide accurate shipment details and ensure cargo complies with all applicable laws and regulations.

  1. Cargo Inspection & Customs Examination

Shipments may be subject to customs or regulatory inspection without prior notice. The Company shall not be liable for resulting delays or costs.

  1. Liability

The Company shall not be liable for indirect or consequential losses including delays caused by airlines, shipping lines, customs authorities, weather, strikes, or force majeure events.

  1. Insurance

Cargo insurance is not included unless specifically requested in writing. Clients are advised to insure cargo against transit risks.

  1. Storage, Demurrage & Detention

Storage, demurrage, detention, and related charges arising from delays outside the Company’s control shall be borne by the Client.

  1. Force Majeure

The Company shall not be liable for delays or failure caused by events beyond its reasonable control including natural disasters, strikes, war, government actions, or port disruptions.

  1. Confidentiality

Client information and shipment details shall be treated confidentially except where disclosure is required for operational or legal purposes.

  1. Claims

Claims for loss or damage must be submitted in writing within 7 days for airfreight and 14 days for sea freight shipments.

  1. Governing Law

These Terms & Conditions shall be governed by the laws of the Republic of Kenya.

  1. Acceptance

Engaging the Company’s services constitutes acceptance of these Terms & Conditions.

Lump-Sum Contracting

The Construction Manager is not required to provide an estimate or contract cost breakdown and does not typically participate in pre-construction.
